• Is prop 8 invalid, that is should it never have been on the ballot because it’s a revision to the constitution instead of an amendment to the constitution?
• Does prop 8 violate the separation of powers doctrine? Is it blocking the courts from enforcing the equal protection clause of the state constitution?
• If prop 8 is constitutional what happens to the couples that are already married?

It will be interesting to see how this goes. It sounds like this will be the end of the line on this particular issue no matter how it goes.
